Moore County Sheriff DWI Arrest Records
The Moore County Sheriff's Office handles DWI arrests throughout the unincorporated parts of the county. Arrest reports, booking records, and jail logs are maintained at the sheriff's office separately from the court records at the clerk offices. You can request these records under the Texas Public Information Act. Submit a written request with the full name of the arrested person, the approximate date of the arrest, and your contact information.
Copies of arrest reports are typically $5.00. Most standard requests are processed within 10 business days. Reports include the deputy's account of the stop, observations of impairment, field sobriety test results, chemical test data, and the charge under Texas Penal Code Chapter 49. If dash camera or body camera footage was captured during the arrest, it can be requested separately but may take additional processing time.
Note: DWI arrests within the city limits of Dumas are handled by the Dumas Police Department. Their records are separate from the county sheriff but the same county court system handles all DWI cases.
License Suspension After a Moore County DWI
A DWI arrest in Moore County triggers the Administrative License Revocation process through Texas DPS on the same day as the arrest. The arresting officer takes the physical license and provides a 40-day temporary permit. The driver has 15 days to file an ALR hearing request. If no request is filed, the suspension becomes final automatically. The ALR is a civil proceeding entirely separate from the criminal DWI case in Moore County court. The governing law is Transportation Code Chapter 524.
First offense refusal to take a chemical test leads to a 180-day suspension. Failing the test at 0.08 or above leads to 90 days. Prior ALR suspensions within the past 10 years double both periods. A $125 reinstatement fee is required before DPS will issue a new license. Driving records showing suspension history are ordered from dps.texas.gov for $4 to $22 depending on the type selected.
DWI Law and Moore County Courts
All DWI charges in Moore County are filed under Texas Penal Code Chapter 49. The per se BAC standard of 0.08 applies to all drivers. The impairment standard, which focuses on loss of normal physical or mental faculties, can apply even at lower BAC readings. A driver in the Texas Panhandle can be charged and convicted under either theory. The Panhandle's flat terrain and long straight roads mean DWI stops often involve high-speed situations that can add reckless driving components to charges.
Crash reports for DWI accidents in Moore County are held by TxDOT. Peace officer crash reports (CR-3) cost $6 for a regular copy and $8 for a certified version. All requests go through the CRIS Request online system. TxDOT no longer accepts mail subpoena requests as of January 2025 and keeps crash records for 10 years plus the current year.
Statewide DWI conviction data is available through the Texas DPS Crime Records Service. This is useful for checking whether a Moore County defendant has prior DWI convictions anywhere in Texas that would elevate the current charge to felony level under Section 49.09.
