Texas DWI Laws and Penalties

Texas DWI and intoxication offenses are all defined in Texas Penal Code Chapter 49. A first offense DWI is a Class B misdemeanor. It carries up to 180 days in jail and a fine of up to $2,000. The mandatory minimum is 72 hours. An open container raises it to six days minimum.

A second DWI is a Class A misdemeanor: up to one year in jail and up to $4,000 in fines. The mandatory minimum is 30 days. If a BAC reading comes in at 0.15 or higher, the charge is elevated to Class A even for a first arrest. The TxDOT impaired driving page explains each penalty tier clearly.

Third offense DWI is a third degree felony: 2 to 10 years in prison and up to $10,000 in fines. DWI with a child passenger under 15 is a state jail felony. Intoxication assault is a third degree felony when someone suffers serious bodily injury. Intoxication manslaughter is a second degree felony, carrying 2 to 20 years in prison. All felony cases go through one of the four Potter County district courts.

Under Texas Alcoholic Beverage Code Section 106.041, any driver under 21 with detectable alcohol in their system faces a DUI charge separate from DWI. Penalties include fines, license suspension, and alcohol education. This charge is separate from the adult DWI statute.

Administrative License Revocation

You have 15 days from the arrest to request an ALR hearing with the State Office of Administrative Hearings. Without a hearing request, the suspension starts automatically on day 40. The temporary permit in the notice is valid for 40 days. A first refusal results in a 180-day suspension. A failed test at or above 0.08 BAC results in a 90-day suspension. To get your license back, pay a $125 reinstatement fee to the Texas DPS.
