Texas DWI Law in Hartley County

The same Texas DWI statutes under Penal Code Chapter 49 apply here. Hartley County is remote and rural in the far northwest Texas Panhandle. US Route 385 and Interstate 40 run through the area. Texas DPS troopers handle a significant share of DWI enforcement on the major highways. The Hartley County Sheriff covers county roads and rural areas.

A DWI in Hartley County follows the same procedure as anywhere in the state. The officer must have probable cause to stop the vehicle, observe signs of intoxication, conduct field sobriety tests, and offer a breath or blood test. If a driver refuses a chemical test, the refusal is noted and the officer may seek a blood draw warrant under Code of Criminal Procedure Article 18.067. Blood samples must be handled with full chain of custody and sent to an accredited lab.

For DWI crashes in Hartley County, the crash report goes to TxDOT within 10 days if there is injury, death, or over $1,000 in damage. Involved parties may purchase the crash report for $6 or $8 certified. The report is separate from the criminal case file but may support the prosecution's case.

Note: Open container enhancement under Penal Code Section 49.04 adds to the minimum jail time even on a first offense. Having any open alcohol container in the vehicle raises the minimum from 72 hours to 6 days.

License Suspension and Driver Records

The Texas DPS Administrative License Revocation process applies in every county including Hartley. After a DWI arrest, the driver has 15 days to request a hearing or the license suspension becomes final. The suspension starts after the 40-day temporary permit runs out. These civil penalties are separate from any criminal proceedings.

First-offense suspension is 90 days for a failed test and 180 days for refusal. Reinstatement requires paying a $125 fee to DPS after the suspension period. The full ALR process is at Transportation Code Chapter 524.

Driving records can be ordered online or by mail at dps.texas.gov. The complete Type 3 record costs $10. You need your license number, date of birth, and DPS audit number to order online. The Texas DPS Crime Records Division also maintains criminal history records including DWI convictions that were submitted by county courts statewide.
