DWI Charges and Penalties in Lubbock
Lubbock DWI prosecutions are governed by Texas Penal Code Chapter 49. A first DWI is a Class B misdemeanor with a minimum 72-hour jail term and up to 180 days. The maximum fine is $2,000. If an open container was present, the minimum goes to six days. A BAC of 0.15 or more means a Class A charge with up to one year in jail and fines up to $4,000. These are criminal penalties, separate from state surcharges and license suspension.
Under Sec. 49.09, a second DWI carries a mandatory minimum of 30 days and Class A designation. A third DWI is a third-degree felony carrying 2 to 10 years in prison and a fine up to $10,000. State surcharges from TxDOT guidelines add $3,000 to $6,000 at sentencing on top of court fines. DWI with a passenger under 15 is a state jail felony under Sec. 49.045. Intoxication manslaughter under Sec. 49.08 is a second-degree felony.
Minor DUI in Lubbock falls under Texas Alcoholic Beverage Code Sec. 106.041. Any driver under 21 with any detectable alcohol is in violation under zero tolerance rules. First offense is a Class C misdemeanor handled by Lubbock Municipal Court. The penalty includes a fine up to $500, 8 to 12 hours of community service, and a mandatory alcohol awareness course. License suspension runs 30 days for a first conviction.
License Suspension After a Lubbock DWI
A DWI arrest in Lubbock triggers the state Administrative License Revocation program. Under Texas Transportation Code Chapter 524, the arresting officer confiscates the physical license and gives a temporary permit valid for 40 days. The driver has 15 days to request a hearing with DPS. Failing to request a hearing means the suspension becomes final on day 40. ALR hearings are held at the State Office of Administrative Hearings and are independent of the criminal DWI case.
A first failed test brings a 90-day suspension. A first refusal to test brings 180 days. Prior ALR events within 10 years increase those periods. Note: Under Texas Code of Criminal Procedure Art. 14.03, officers may arrest without a warrant persons found in circumstances suggesting guilt of DWI.
