Lubbock County District Clerk

The Lubbock Police Department handles records requests for incidents investigated within city limits. DWI arrest reports from LPD include the officer's probable cause statement, field sobriety test results, preliminary breath test data, and any chemical test results. These records are separate from the court case files. You will need to request them directly from LPD. Processing times vary. Standard reports generally come back within 10 business days.

Texas DWI Charges and Penalties

Under Texas Penal Code Section 49.04, DWI means operating a motor vehicle in a public place while intoxicated. "Intoxicated" has two meanings: either a BAC of 0.08 or more, or impairment of mental or physical faculties due to alcohol, drugs, or other substances. This dual standard lets prosecutors charge DWI even if a BAC reading is below 0.08, as long as the driver showed signs of impairment.

First offense DWI is a Class B misdemeanor. The minimum is 72 hours in jail, up to 180 days, and a fine up to $2,000. An open container in the car raises the minimum to six days. A BAC of 0.15 or higher makes it a Class A misdemeanor with up to one year and fines up to $4,000. Second offense adds a mandatory 30-day minimum. Third offense is a felony with two to ten years in prison. The TxDOT impaired driving summary lists all penalty levels on their public safety page.

For drivers under 21, Texas Alcoholic Beverage Code Section 106.041 applies. Any detectable alcohol is enough for a DUI charge. No BAC threshold applies. This zero-tolerance rule means a minor can face a license suspension and fine even with a very low alcohol reading.

Intoxication with a child under 15 in the car is a state jail felony under Section 49.045. It carries 180 days to two years in state jail and fines up to $10,000 -- all of that on top of any child endangerment charges the county might also pursue.

License Suspension and ALR Process

When someone is arrested for DWI in Lubbock County, the officer takes the physical license and issues a temporary driving permit valid for 40 days. The driver has 15 days from the arrest to request an ALR hearing. Under Texas Transportation Code Chapter 524, failing to request a hearing means the suspension takes effect on day 40 with no further review.

Refusing a breath or blood test brings a 180-day suspension for a first offense. A second refusal within ten years means a two-year suspension. Failing the test at 0.08 or above results in a 90-day suspension for a first offense or one year with a prior. Getting your license reinstated requires a $125 fee paid to Texas DPS. Driving records can be ordered through the DPS driver record system for $4 to $22 depending on the type.

Crash Records in Lubbock County

DWI cases involving crashes generate a Peace Officer's Crash Report (CR-3) on file with TxDOT. These are separate from the criminal court records. A regular copy costs $6.00. A certified copy runs $8.00. Orders go through the TxDOT CRIS online system. Crash reports are available only to parties with a direct interest: drivers, owners, insurers, and attorneys.
