DWI Laws Affecting Midland Cases

Texas DWI law starts with Penal Code Section 49.04. The offense is operating a motor vehicle in a public place while intoxicated. Intoxicated means either a BAC of 0.08 or higher, or not having normal use of mental or physical faculties due to alcohol or drugs. Officers can charge based on observed impairment without a BAC result above the limit.

First offense DWI is a Class B misdemeanor with 72 hours to 180 days in jail and a fine up to $2,000. An open container in the vehicle raises the jail minimum to six days. A BAC of 0.15 or more makes the charge a Class A misdemeanor with up to one year in jail and a $4,000 fine. State surcharges at sentencing run $3,000 for a first offense and up to $6,000 for a third. Second DWI carries a 30-day mandatory minimum as a Class A misdemeanor.

Under Section 49.09, a third DWI is a third-degree felony with two to ten years in prison and up to $10,000 in fines. Felony DWI records are filed with the Midland County District Clerk. DWI with a child passenger under 15 is a state jail felony under Section 49.045 with 180 days to two years in a state jail facility, regardless of prior convictions.

For drivers under 21, Alcoholic Beverage Code Section 106.041 applies. Any detectable alcohol is enough for a DUI charge. First offense is a Class C misdemeanor with a fine up to $500 and mandatory 8 to 12 hours of community service. Those cases are typically handled by municipal courts rather than the county courts.

ALR and License Suspension in Midland

A DWI arrest in Midland starts two separate processes. The criminal case goes to Midland County Court or District Court depending on the charge level. The Administrative License Revocation process runs through the Texas DPS at the same time. These are independent. A dismissed criminal case does not stop the ALR suspension.

When the officer makes the arrest, they take the physical license and issue a Notice of Suspension. That notice doubles as a 40-day temporary driving permit. The driver has 15 days to request an ALR hearing. If no hearing is requested, the suspension takes effect on day 40. Under Transportation Code Chapter 524, failing a chemical test means a 90-day suspension for a first offense. Refusing the test means 180 days. Prior suspensions within 10 years trigger two-year suspensions on subsequent arrests.

The ALR hearing is held before a State Office of Administrative Hearings judge. The standard for suspension is lower than criminal court. After the suspension period, a $125 reinstatement fee goes to DPS. You can order your driving record at dps.texas.gov to check status. Online records range from $4 to $22 depending on the type of history requested.
