DWI Laws in Texas

Texas DWI offenses are all defined in Texas Penal Code Chapter 49. A first DWI is a Class B misdemeanor with up to 180 days in jail and a fine of up to $2,000. The mandatory minimum is 72 hours in jail. If an open container was present, that minimum goes up to six days.

A second DWI is a Class A misdemeanor: up to one year in jail and a $4,000 fine. The mandatory minimum is 30 days. A third DWI conviction is a third degree felony: 2 to 10 years in prison and up to $10,000 in fines. DWI with a child passenger under 15 is a state jail felony. Intoxication assault is a third degree felony when serious bodily injury results. Intoxication manslaughter is a second degree felony with 2 to 20 years in prison. All felony DWI charges in Presidio County go through the 83rd Judicial District Court.

Under Texas Alcoholic Beverage Code Section 106.041, any driver under 21 with any detectable amount of alcohol in their system can be charged with DUI. This is separate from DWI and results in fines, license suspension, and required alcohol education classes.

Administrative License Revocation

After a DWI arrest in Presidio County, the arresting officer takes the physical license and issues a Notice of Suspension. The Texas DPS manages this civil process under Texas Transportation Code Chapter 524, which is the Administrative License Revocation program.

You have 15 days from the arrest to request an ALR hearing. Without a hearing request, the license suspension takes effect on day 40. The temporary permit in the notice is valid for 40 days. A first refusal results in a 180-day suspension. A failed chemical test at or above 0.08 BAC results in a 90-day suspension. To reinstate the license, pay a $125 fee to the Texas DPS.

Note: The ALR suspension is a civil proceeding separate from the criminal DWI case. The license can be suspended even if the criminal charge is dismissed.
