Texas DWI Laws and Penalty Levels

All DWI and related offenses in Texas are defined in Texas Penal Code Chapter 49. A first offense DWI is a Class B misdemeanor. Penalties include up to 180 days in jail and a fine of up to $2,000. There is a mandatory 72-hour jail minimum. If an open container was found in the vehicle, the minimum goes up to six days.

A second DWI conviction is a Class A misdemeanor, carrying up to one year in jail and a $4,000 fine. The mandatory minimum for a second offense is 30 days in jail. A third DWI becomes a third degree felony: 2 to 10 years in prison and up to $10,000 in fines. DWI with a child passenger under age 15 is a state jail felony. Intoxication assault is a third degree felony when the victim suffers serious bodily injury. Intoxication manslaughter is a second degree felony and carries 2 to 20 years in prison. These charges all go through the 83rd Judicial District Court.

Drivers under 21 face a separate DUI charge under Texas Alcoholic Beverage Code Section 106.041 if any detectable amount of alcohol is found in their system. This is not a DWI charge, but it does result in fines, mandatory alcohol education, and license suspension.

Administrative License Revocation

After a DWI arrest in Pecos County, the officer takes the physical license and issues a Notice of Suspension. This triggers the state's Administrative License Revocation process. The Texas DPS handles ALR under Texas Transportation Code Chapter 524.

You have 15 days from the arrest date to request an ALR hearing. If you miss this deadline, your license is automatically suspended on day 40. The temporary permit in the Notice of Suspension is valid for 40 days. A first-time refusal to submit to chemical testing results in a 180-day suspension. A failed test at or above 0.08 BAC brings a 90-day suspension. You must pay a $125 reinstatement fee to the Texas DPS before your license is restored.

Note: The ALR process is civil and separate from the criminal case. Your license can be suspended even if the criminal DWI charge is dismissed or you are found not guilty.
