Walker County District Clerk

Walker County Clerk - Misdemeanor DWI

The Walker County Clerk keeps all misdemeanor DWI records through the County Court at Law. First-offense DWI is a Class B misdemeanor under Texas Penal Code Section 49.04 with a minimum of 72 hours in jail. Second offense is a Class A misdemeanor with a mandatory 30-day minimum. A first offense with a BAC of 0.15 or more is also elevated to Class A under the same section.

The Huntsville Police Department handles DWI arrest records for the city of Huntsville. Records can be requested at (936) 294-5700. The Records Division is at 1220 14th Street. Reports are available for incident, accident, and arrest cases. Processing takes about 10 business days. The fee is $5.00 per report. Requests can be submitted online through the city's portal.

DWI arrests by the Huntsville Police Department appear in both city records and Walker County court records. After arrest, cases move into the county court system for prosecution. Huntsville Municipal Court

The Huntsville Municipal Court handles Class C misdemeanor cases in the city. That includes public intoxication, open container violations, and minor in possession charges that can appear alongside a DWI case. The court is at 1220 14th Street and can be reached at (936) 294-5710. Online case search and ticket payment are available through the city's portal.

Municipal Court records are separate from Walker County court records. Deferred disposition may be available for eligible Class C cases. Class C cases are retained for five years after final disposition. These records do not reflect the DWI charge itself, which is handled at the county court level.

Driver License Suspension After a DWI

After a DWI arrest in Walker County, the Texas DPS Administrative License Revocation process begins immediately. The officer takes the physical license and hands the driver a 40-day temporary permit. The driver has just 15 days to request an ALR hearing or the suspension becomes final. This is a civil process separate from the criminal DWI case in court. The full ALR framework is in Transportation Code Chapter 524.

For a first offense, refusing a chemical test means a 180-day suspension. Failing at a BAC of 0.08 or above means 90 days. If there was a prior ALR suspension in the last 10 years, those periods double. A $125 reinstatement fee must be paid to DPS before a new license can be issued. Driving records can be ordered at dps.texas.gov for $4 to $22 depending on type. The Type 3A certified record costs $10 online.

Note: The ALR suspension stands even if the criminal DWI case is dismissed or the defendant is acquitted. These are two separate legal proceedings.

Walker County prosecutes DWI under Texas Penal Code Chapter 49. Section 49.04 covers the standard DWI offense. The open container enhancement adds three days to the minimum jail time for a first offense. DWI with a child passenger under 15 is a state jail felony under Section 49.045, regardless of how many prior convictions exist. That charge is always filed at the District Clerk level.
