Victoria County Clerk - Misdemeanor DWI Records

The Victoria County Clerk maintains all misdemeanor DWI records. First-offense DWI is a Class B misdemeanor under Texas Penal Code Section 49.04, with a minimum of 72 hours in jail. The Victoria Police Department Records Division handles DWI arrest records for the city of Victoria. The Records Division is at 306 S. Main Street and can be reached at (361) 485-3700 or by email at policerecords@victoriatx.org. Business hours are Monday through Friday, 8:00 AM to 5:00 PM. Report requests can be submitted online through the city's records portal.

The Victoria Police Department processes arrest reports, incident reports, and accident reports. DWI arrest files include the officer's observations, field sobriety test notes, BAC results, and booking details. Report fees range from $5.00 to $6.00 depending on the type. Processing usually takes 5 to 10 business days. Payment is accepted online, in person, or by mail.

The Victoria Police Department also issues records for traffic accident crashes involving DWI. Those crash reports follow TxDOT's CR-3 form process. Crash reports can be purchased directly through TxDOT's CRIS system for $6 (standard) or $8 (certified).

Victoria Municipal Court

The Victoria Municipal Court handles Class C misdemeanor cases filed within the city. While DWI itself is not a Class C offense, the Municipal Court does handle related charges like open container violations, public intoxication, and minor in possession cases that can appear alongside a DWI arrest. License Suspension and DPS Records

After a DWI arrest in Victoria County, Texas DPS starts the Administrative License Revocation process. The officer takes the physical license and issues a 40-day temporary permit. The driver has 15 days to request an ALR hearing or the suspension takes effect automatically. The ALR process is governed by Transportation Code Chapter 524 and runs separate from the criminal case.

For adults on a first offense, refusing a breath or blood test leads to a 180-day suspension. Failing the test at 0.08 or above means 90 days. A $125 reinstatement fee applies before DPS will issue a new license. Driving records can be ordered from dps.texas.gov. The Type 3A certified complete history costs $10 online and is often required for legal purposes.

Texas DWI Law in Victoria County

Victoria County prosecutes DWI under Texas Penal Code Chapter 49. A first DWI is a Class B misdemeanor. If the driver had an open container of alcohol in the car, the minimum jail time goes up to six days. A BAC of 0.15 or above raises the charge to a Class A misdemeanor. The law also covers DWI on waterways under the boating while intoxicated statute.

A third DWI conviction is a third-degree felony under Section 49.09. Prior DWI, BWI (boating while intoxicated), or FWI (flying while intoxicated) convictions all count toward the enhancement. Intoxication assault under Section 49.07 is a third-degree felony when serious bodily injury occurs. It becomes a second or first-degree felony if the victim is a peace officer, firefighter, or EMS worker on duty.

Intoxication manslaughter under Section 49.08 is a second-degree felony. If the victim was a peace officer or judge in the discharge of duty, it rises to a first-degree felony with 5 to 99 years or life in prison.
