DWI Law and Upshur County Cases

Upshur County prosecutes all DWI cases under Texas Penal Code Chapter 49. The standard first offense is Class B. A BAC of 0.15 or higher at first arrest is Class A. A second offense is always Class A, with a mandatory minimum of 30 days in jail. A third offense is a third-degree felony.
