Sutton County Clerk
Misdemeanor DWI records are held by the County Clerk. First offense DWI under Section 49.04 is a Class B misdemeanor. Second offense is a Class A with a 30-day minimum sentence. Records are available in person. The County Clerk office is at the same Oak Street address as the District Clerk.

DWI Law and Records Access
Texas DWI is defined in Penal Code Chapter 49. A BAC of 0.08 or proven impairment supports a DWI charge. For minors under 21, Alcoholic Beverage Code Section 106.041 applies zero tolerance. The ALR program under Transportation Code Chapter 524 handles license suspension separately from the criminal case. Drivers have 15 days after arrest to request an ALR hearing.
