Texas DWI Basics

Under Penal Code Section 49.04, a person commits DWI by operating a motor vehicle in a public place while intoxicated. Intoxication means a BAC of 0.08 or higher, or impaired mental or physical faculties caused by alcohol or drugs. Both standards apply in Somervell County courts.

First offense is a Class B misdemeanor. Second offense is a Class A. Third offense is a third-degree felony. Additional surcharges from $3,000 to $6,000 are assessed at sentencing under Texas law on top of the standard fines. Texas also suspends the license through the ALR program under Transportation Code Chapter 524. A driver has 15 days after arrest to request an ALR hearing, or the suspension takes effect automatically.

For drivers under 21, Alcoholic Beverage Code Section 106.041 applies a zero tolerance standard. Any detectable alcohol leads to charges. Minor DUI carries fines, community service, and mandatory alcohol education even on a first offense.

Driving records showing DWI-related suspensions can be ordered from DPS online. The Type 3A certified complete history costs $10. Crash reports from DWI accidents can be purchased through TxDOT's CRIS system for $6 to $8 per report.
