Texas DWI Laws

Texas DWI offenses are defined in Texas Penal Code Chapter 49. A first offense is a Class B misdemeanor, meaning up to 180 days in jail and a fine of up to $2,000. There is a mandatory 72-hour jail minimum. An open container in the vehicle raises that minimum to six days.

A second DWI is a Class A misdemeanor, carrying up to one year in jail and up to a $4,000 fine. The mandatory minimum for a second offense is 30 days in jail. Intoxication assault causing serious bodily injury is a third degree felony. Intoxication manslaughter is a second degree felony with 2 to 20 years in prison. All felony cases in Parker County go to the District Clerk.

Under Texas Alcoholic Beverage Code Section 106.041, any driver under 21 with detectable alcohol faces a separate DUI charge. This carries fines, license suspension, and required alcohol education, and is separate from the DWI statute.

Administrative License Revocation

After a DWI arrest in Parker County, the officer takes the physical license and gives the driver a Notice of Suspension. This triggers the Administrative License Revocation program run by the Texas DPS under Texas Transportation Code Chapter 524.

You have 15 days from the arrest to request an ALR hearing. If you do not request a hearing, suspension starts automatically on day 40. The temporary permit in the Notice of Suspension is good for 40 days. A first-time refusal to take a chemical test brings a 180-day suspension.
