The Milam County Clerk maintains misdemeanor DWI records from the County Court at Law in Cameron. First and second offense DWI are Class B and Class A misdemeanors under Penal Code Sections 49.04 and 49.09. First offense carries 72 hours to 180 days in jail and fines up to $2,000. Sheriff's DWI arrest reports contain the deputy's narrative, field sobriety test results, chemical test results, and booking information. The sheriff's office records are separate from the court records maintained by the clerks at 102 S. Fannin.

Texas DWI Law and Milam County Cases

Milam County DWI cases follow Texas Penal Code Chapter 49. The first offense under Section 49.04 is a Class B misdemeanor. A BAC of 0.15 or above makes it a Class A. Second offense DWI has a 30-day mandatory minimum jail term. Third offense is a third-degree felony. DWI with a child under 15 is a state jail felony under Section 49.045. License Suspension After a Milam County DWI Arrest

The Texas DPS Administrative License Revocation program applies to every DWI arrest in Milam County. The arresting officer takes the physical license and provides a 40-day temporary permit. The driver has 15 days to request an ALR hearing with DPS. If no request is made, the suspension is automatic. This is a civil process and is completely separate from the criminal DWI case in the 20th District Court or the county court at law.

For a first offense adult who refuses chemical testing, the suspension is 180 days. Failing the test at 0.08 or above is a 90-day suspension. Prior ALR suspensions within 10 years double these periods. A $125 reinstatement fee applies before DPS issues a new license. All of this is laid out in Transportation Code Chapter 524. Even if the criminal charge in Milam County is dismissed, the ALR suspension stands unless the driver wins the ALR hearing separately.
