Liberty County District Clerk

The Liberty County District Clerk maintains all felony DWI records for the county. Three district courts serve Liberty County: the 75th, 253rd, and 365th District Courts. These courts handle third or higher DWI offenses, intoxication assault, and intoxication manslaughter. Under Texas Penal Code Chapter 49, a third DWI is a third-degree felony. Intoxication manslaughter is a second-degree felony with 2 to 20 years in prison. Records from all three courts are held permanently.

Liberty County Clerk - Misdemeanor DWI Records

The Liberty County Clerk maintains misdemeanor DWI records for the county's two County Courts at Law. A first DWI under Texas Penal Code Section 49.04 is a Class B misdemeanor with a minimum 72-hour jail term and a fine up to $2,000. A BAC of 0.15 or higher makes it a Class A misdemeanor with up to a year in jail. Second DWI is a Class A with a mandatory 30-day minimum under Section 49.09. All misdemeanor DWI records are kept permanently and include the charge, BAC result, plea, and outcome.

Contact the department at (936) 336-5666 for arrest report requests. DWI reports include the officer's narrative, field sobriety test results, BAC data from chemical tests, and the formal charge. Reports are $5.00 per copy. In-person requests are the primary method for obtaining these records.

Other cities in Liberty County, including Dayton and Cleveland, have their own police departments with separate records divisions. Driver License Suspension After DWI Arrest

A DWI arrest in Liberty County immediately triggers the Texas DPS Administrative License Revocation process. The arresting officer confiscates the physical license and provides a 40-day temporary driving permit. The driver has exactly 15 days from the arrest to request an ALR hearing. If no hearing request is filed, the suspension happens automatically when the temporary permit expires. This process is governed by Transportation Code Chapter 524 and is completely separate from the criminal case in county or district court.

Refusing the chemical test on a first offense leads to a 180-day suspension. Failing at 0.08 or above brings a 90-day suspension. Prior ALR history within 10 years doubles each of those periods. Reinstatement requires a $125 fee paid to Texas DPS. Even if the criminal DWI case is dismissed, the ALR suspension can remain in effect unless it was separately contested and won.

Texas DWI Law and Liberty County Cases

Liberty County DWI cases are prosecuted under Texas Penal Code Chapter 49. The law defines the base offense in Section 49.04 as operating a motor vehicle in a public place while intoxicated. Texas uses two separate tests for intoxication. The per se standard uses a BAC of 0.08 or above.
