Texas DWI Law in Jasper County

DWI cases in Jasper County follow Texas Penal Code Chapter 49. A driver is legally intoxicated when their blood alcohol level reaches 0.08 or when their mental or physical abilities are impaired by alcohol or drugs. Both definitions can result in a DWI charge, even if the driver's BAC is below 0.08.

A first DWI is a Class B misdemeanor with up to 180 days in jail and a $2,000 fine. Minimum jail time is three days. If the driver had an open container at the time of arrest, the minimum rises to six days. A high BAC of 0.15 or more makes it a Class A misdemeanor with up to one year in jail and a $4,000 fine.

Second convictions are Class A misdemeanors with a required minimum of 30 days in jail. Third or later DWI convictions are third-degree felonies handled by the 1st or 253rd District Court. Felony DWI can mean two to ten years in prison. Intoxication manslaughter is a second-degree felony under Section 49.08, which can mean up to 20 years in prison.

ALR and License Suspension in Jasper County

A DWI arrest in Jasper triggers the Administrative License Revocation process handled by the Texas Department of Public Safety. This is a civil action separate from the criminal court case. DPS can suspend a license for failing or refusing a breath or blood test.

The arresting officer takes the license at the time of arrest and gives the driver a temporary permit valid for 40 days.
