Hudspeth County Sheriff DWI Arrests
The Hudspeth County Sheriff's Office handles DWI arrests throughout the county, including along the stretch of Interstate 10 that crosses through this part of West Texas. DWI stops on I-10 are common because the highway runs across the entire county. The sheriff's office maintains arrest reports, incident reports, and jail booking records. Contact the sheriff directly for copies of arrest reports or booking records related to DWI cases.
Arrest report copies cost $5.00. Processing times for record requests vary but expect up to 10 business days for standard requests. Reports will include the officer's observations, field sobriety test results, chemical test data, and the formal charge under Texas Penal Code Section 49.04. Video evidence from patrol units may be requested separately and can take longer to produce.
Note: Hudspeth County shares the 34th District Court with El Paso County, so some felony DWI hearings may be held in El Paso rather than Sierra Blanca.
License Suspension and Texas DPS
After a DWI arrest in Hudspeth County, Texas DPS starts the Administrative License Revocation process right away. The arresting officer takes the physical license and gives the driver a 40-day temporary permit. The driver then has 15 days to request an ALR hearing or the suspension takes effect automatically. The ALR process is separate from the criminal case in district or county court.
For a first DWI offense, refusing a breath or blood test leads to a 180-day suspension. Failing the test at 0.08 or above results in a 90-day suspension. Prior ALR suspensions within 10 years double those periods. Even if the criminal charges get dismissed, the ALR suspension can still stand on its own. This is governed by Transportation Code Chapter 524. A $125 reinstatement fee must be paid before DPS will issue a new license.
Driving records can be ordered from dps.texas.gov. Fees range from $4 to $22 depending on the record type. The Type 3A certified complete history is the one most often needed for legal matters and costs $10 online.
