Texas DWI Law Applied in Concho County

Concho County uses the same DWI statutes as the rest of Texas. The base offense under Penal Code Chapter 49 is operating a motor vehicle in a public place while intoxicated. Texas law defines intoxicated two ways: lacking normal use of mental or physical faculties due to any substance, or having a blood alcohol concentration of 0.08 or above. Prosecution can proceed under either definition.

Felony levels of DWI carry more serious consequences. Intoxication assault under Section 49.07 is a third-degree felony carrying two to ten years in prison. Intoxication manslaughter under Section 49.08 is a second-degree felony with two to twenty years. If the victim is a peace officer, firefighter, or judge on duty, the charge can step up to a first-degree felony. Concho County records from the District Clerk show how these charges were filed and resolved.

For crash reports tied to DWI incidents, TxDOT is the official custodian. The peace officer crash report costs $6 for a standard copy and $8 for a certified copy. All requests go through TxDOT's CRIS Request system online. As of January 2025, TxDOT no longer accepts subpoena requests by mail.

Minors driving with any detectable alcohol are charged under Alcoholic Beverage Code Section 106.041. The zero tolerance rule for under-21 drivers is a separate charge from adult DWI, but it still results in license suspension and mandatory alcohol education.

Administrative License Revocation in Concho County

Every DWI arrest in Concho County triggers the Texas DPS Administrative License Revocation process. The arresting officer takes the physical driver's license and issues a 40-day temporary permit. The driver has 15 days to request an ALR hearing. If no hearing is requested, suspension takes effect on day 40.

Suspension periods for adults are set by Transportation Code Chapter 524. Refusing to submit to a chemical test means 180 days for a first offense, or two years if there was a prior refusal within 10 years. Failing the test at 0.08 or above means 90 days on a first offense, or one year with a prior suspension in the past 10 years. The ALR hearing is a civil process, separate from the criminal case, and is held before an administrative law judge at the State Office of Administrative Hearings.

After the suspension, a $125 reinstatement fee is due before DPS will issue a new license. Driving records are ordered online at dps.texas.gov. Record types range from $4 to $22. DPS does not accept phone orders for driving records.
