DWI Laws and Brazos County Cases
Brazos County cases are prosecuted under Texas Penal Code Chapter 49. A first DWI offense with BAC under 0.15 is a Class B misdemeanor. Minimum jail time is 72 hours. Maximum is 180 days. Fine up to $2,000. A BAC of 0.15 or above raises the first offense to Class A with up to one year in jail and fines up to $4,000.
Second DWI has a mandatory 30-day minimum. Third DWI is a third-degree felony with 2 to 10 years in prison and fines up to $10,000. For drivers under 21, Texas enforces a zero-tolerance rule under Alcoholic Beverage Code Section 106.041. Any detectable alcohol while operating a vehicle is enough for a DUI charge. First offense is a Class C misdemeanor. Given the large student population in College Station, this charge comes up more frequently in Brazos County than in many other Texas counties.

License Suspension After DWI Arrest in Brazos County
After a DWI arrest anywhere in Brazos County, Texas DPS starts the Administrative License Revocation process. The officer takes the physical license at arrest and gives a 40-day temporary permit. You have exactly 15 days to request an ALR hearing with the State Office of Administrative Hearings. After 15 days, the right to contest is gone and the suspension takes effect on day 41.
The ALR process is a civil administrative proceeding, completely separate from the criminal case. Under Transportation Code Chapter 524, refusing a chemical test means 180 days for a first refusal. Failing the test at 0.08 or above means 90 days. Second violations within 10 years double those periods. Even a not-guilty verdict in criminal court does not reverse an ALR suspension unless the ALR hearing was also won.
