Administrative License Revocation

Every DWI arrest in Bexar County triggers the ALR process. The arresting officer gives you a Notice of Suspension that serves as a 40-day temporary permit. You have 15 days to request an ALR hearing. Missing this deadline means automatic suspension starting on day 40. The Central Magistrate facility at 200 N. Comal St. processes all DWI bookings in Bexar County around the clock.

Refusing chemical testing means a 180-day first-offense suspension. A failed test means 90 days for a first offense. Suspension periods are longer for repeat offenses within 10 years. The ALR hearing is before the State Office of Administrative Hearings and uses a preponderance of evidence standard. The hearing examines whether the officer had reasonable suspicion to stop you, probable cause for arrest, and whether you were properly asked to submit to testing.

To reinstate your license, pay a $125 fee to Texas DPS. The statute governing the ALR process is Transportation Code Chapter 524. The ALR case runs completely separate from the criminal DWI case. A favorable outcome in one does not affect the other.
