Texas DWI Laws Applicable in Pearland

Texas DWI law is in Penal Code Chapter 49. The charge under Section 49.04 applies when someone operates a motor vehicle in a public place while intoxicated. Intoxicated means either a BAC of 0.08 or more, or losing normal use of mental or physical faculties because of alcohol or drugs. Officers can charge based on either standard. A person can be charged based on impairment alone, without a breath test result above the legal limit.

First offense DWI is a Class B misdemeanor with 72 hours to 180 days in jail and up to a $2,000 fine. Open container raises the minimum jail time to six days. A BAC of 0.15 or more upgrades the charge to Class A, meaning up to one year in jail and a $4,000 fine. Texas adds state surcharges at sentencing that run from $3,000 on a first offense up to $6,000 for a third. Second DWI carries a mandatory 30-day minimum as a Class A misdemeanor.

Under Section 49.09, a third DWI is a third-degree felony with two to ten years in prison. DWI with a child under 15 is a state jail felony under Section 49.045, carrying 180 days to two years. For drivers under 21, Alcoholic Beverage Code Section 106.041 applies. Any detectable alcohol is enough for a minor DUI charge, which is a Class C misdemeanor for a first offense.

License Suspension After a Pearland DWI Arrest

When someone is arrested for DWI in Pearland, two separate processes start. The criminal case goes to Brazoria County court. The Administrative License Revocation process is handled separately by the Texas DPS. They run at the same time and are independent. Getting the criminal case dismissed does not prevent DPS from suspending the license through the ALR process.

At the time of arrest, the officer takes the physical license and issues a Notice of Suspension as a 40-day temporary permit. The driver has 15 days to request a hearing with the State Office of Administrative Hearings. If no hearing is requested, the suspension takes effect on day 40. Under Transportation Code Chapter 524, failing a chemical test means a 90-day suspension for a first offense. Refusing the test brings a 180-day suspension. Prior suspensions or refusals within 10 years lead to two-year suspension periods.

After the suspension period ends, a $125 reinstatement fee must be paid to DPS. You can check your license status and order your driving record at dps.texas.gov. Online records show current status, suspension history, and violations. They cost $4 to $22 depending on the type.
