DWI Laws That Apply in Mesquite

Texas DWI law comes from Penal Code Chapter 49. A DWI charge applies when a person drives a motor vehicle in a public place while intoxicated. The law defines intoxicated two ways. Either the driver's blood alcohol concentration is 0.08 or more, or alcohol or drugs have reduced their normal mental or physical abilities. An officer can make an arrest based on observed impairment even without a breath or blood test result.

A first offense DWI in Texas is a Class B misdemeanor. The minimum jail time is 72 hours. The maximum is 180 days. The fine can go up to $2,000. But if the driver had an open container in the car, the minimum jail time rises to six days. A BAC of 0.15 or higher upgrades the charge to Class A, which means up to one year in jail and a $4,000 fine. The state also imposes surcharges at sentencing on top of court fines. Those surcharges run from $3,000 for a first conviction up to $6,000 for a third.

A second DWI is a Class A misdemeanor with a 30-day mandatory minimum jail sentence. Under Section 49.09, a third DWI becomes a third-degree felony. That carries two to ten years in state prison and a fine up to $10,000. Felony DWI records go through the Dallas County District Clerk.

Drivers under 21 face a separate charge. Under Alcoholic Beverage Code Section 106.041, any detectable alcohol in a minor's system is enough for a DUI charge. This is Texas's zero tolerance law. A first offense for a minor is a Class C misdemeanor with a fine up to $500 and 8 to 12 hours of community service related to alcohol education.

ALR and License Suspension After a Mesquite DWI

A DWI arrest in Mesquite triggers two separate processes. The criminal case goes to Dallas County court. The license suspension is handled by the Texas DPS through the Administrative License Revocation program. These run at the same time. The ALR outcome does not depend on what happens in criminal court. A driver can be found not guilty in Dallas County court and still lose their license through ALR.

After the arrest, the officer confiscates the driver's license and gives them a Notice of Suspension. This notice doubles as a temporary driving permit for 40 days. The driver has 15 days to request an ALR hearing. If they miss that window, the suspension takes effect automatically on day 40. Suspension periods under Transportation Code Chapter 524 run 90 days for a failed test and 180 days for a refusal. Prior suspensions within 10 years mean longer periods on subsequent arrests.

After the suspension ends, a $125 reinstatement fee is owed to DPS. You can check your license status or order your full driving record at dps.texas.gov. Driving records show current license status, any holds, and the history of violations and suspensions.
