DWI Laws and Penalties in Laredo
Laredo DWI cases are prosecuted under Texas Penal Code Chapter 49. A first DWI is a Class B misdemeanor with a minimum of 72 hours in jail and up to 180 days, plus fines up to $2,000. An open container in the vehicle bumps the minimum to six days. A BAC of 0.15 or more makes the charge a Class A misdemeanor with up to one year in jail and fines up to $4,000. Texas law allows arrest based on behavioral impairment even if BAC is below 0.08.
Second DWI under Sec. 49.09 has a mandatory 30-day minimum. A third conviction becomes a third-degree felony with 2 to 10 years in prison. DWI with a child passenger under 15 is a state jail felony under Sec. 49.045. Intoxication assault (Sec. 49.07) and intoxication manslaughter (Sec. 49.08) carry felony penalties. State surcharges under TxDOT guidelines add $3,000 to $6,000 at sentencing on top of any fine ordered by the court.
Laredo's border location means that drivers may interact with both Texas and federal law enforcement. DWI arrests by Laredo PD are prosecuted under state law in Webb County courts. Federal law enforcement DUI cases would be handled in a separate federal court system.
Administrative License Revocation in Laredo
After a DWI arrest in Laredo, the Administrative License Revocation program begins automatically. Under Texas Transportation Code Chapter 524, the arresting officer takes the physical license and issues a temporary permit valid for 40 days. The driver has 15 days to request a hearing at the State Office of Administrative Hearings. Missing this deadline means the suspension takes effect automatically on day 40.
A first failed chemical test means a 90-day suspension. A first refusal means 180 days. Prior ALR suspensions within 10 years increase those periods. The $125 reinstatement fee is due to Texas DPS after the suspension ends. DPS driver records showing the full history can be ordered at dps.texas.gov for $4 to $22 depending on record type.
Note: The ALR proceeding is separate from the criminal case. An ALR suspension can stand even if criminal charges are dismissed. The administrative hearing uses a lower burden of proof than the criminal standard.
