Texas DWI Laws and Penalties

Texas defines DWI under Penal Code Section 49.04. You are legally intoxicated if your blood alcohol concentration hits 0.08 or if alcohol or drugs have impaired your normal use of mental or physical faculties. Both definitions can support a charge. Officers can arrest based on impairment even if a breath test comes back below 0.08.

A first DWI is a Class B misdemeanor. It carries a minimum of 72 hours in jail and a maximum of 180 days, along with a fine of up to $2,000. That is just the base charge. If the driver had an open container in the car, the minimum jail time jumps to six days. If the BAC was 0.15 or higher, the charge bumps up to a Class A misdemeanor under the same statute, which means up to a year in jail and a $4,000 fine. Texas also tacks on state fines at sentencing that can run from $3,000 to $6,000 depending on the offense level. Those are separate from court-ordered fines.

Second DWI convictions are Class A misdemeanors with a mandatory 30-day minimum. A third conviction is a third-degree felony under Section 49.09, which can mean two to ten years in prison. The state keeps records of prior DWI convictions going back indefinitely. A conviction for DWI with a child in the vehicle under 15 is a state jail felony under Section 49.045, no matter how many prior convictions a person has.

License Suspension After a Killeen DWI

When someone is arrested for DWI in Killeen, the officer takes the driver's license and hands the driver a Notice of Suspension. That notice acts as a temporary driving permit for 40 days. The driver has 15 days from the date of arrest to request an Administrative License Revocation hearing. This is a civil process run by the Texas DPS, separate from the criminal case in Bell County court.

The ALR hearing is held before a State Office of Administrative Hearings judge. The standard for the ALR is lower than criminal court. The judge only needs to find that there was reasonable suspicion for the stop, probable cause to believe the driver was intoxicated, and that a test was properly requested. If the driver failed a test, the suspension is 90 days for a first offense. If they refused, it is 180 days under Transportation Code Chapter 524. Second offenses carry longer periods.

After the suspension period ends, the driver must pay a $125 reinstatement fee to DPS before they can get their license back. Driving records showing suspension status, prior violations, and reinstatement history can be ordered through dps.texas.gov. Online records cost $4 to $22 depending on the type.
