DWI Laws and Penalties Applicable in Edinburg
Texas DWI law under Penal Code Chapter 49 applies the same way in Edinburg as anywhere in the state. Under Section 49.04, it is an offense to operate a motor vehicle while intoxicated in a public place. Intoxicated means either a BAC of 0.08 percent or higher, or any level of impairment from alcohol or drugs that affects mental or physical function. Officers can charge DWI under either standard.
A first DWI is a Class B misdemeanor with a minimum of 72 hours in jail, up to 180 days maximum, and fines up to $2,000. Having an open container in the vehicle raises the minimum to six days. BAC at 0.15 or above makes the first offense a Class A misdemeanor, with up to one year in jail and fines up to $4,000. A second offense is a Class A misdemeanor with a mandatory minimum of 30 days. A third or subsequent DWI is a third-degree felony under Section 49.09, carrying two to ten years in prison and fines up to $10,000. State surcharges of $3,000, $4,500, or $6,000 are assessed at sentencing beyond what the court orders.
Driving with a child under 15 in the vehicle while intoxicated is a state jail felony under Section 49.045, carrying 180 days to two years in state jail and a $10,000 fine. Intoxication assault causing serious bodily injury is a third-degree felony. Intoxication manslaughter is a second-degree felony with two to twenty years. Hidalgo County courts often grant deferred adjudication to first-time offenders, which allows the case to be dismissed after completing a supervision period of 12 to 24 months. Records of deferred adjudication cases are still maintained by the clerk.
Minors under 21 face zero tolerance under Alcoholic Beverage Code Section 106.041. Any detectable alcohol while driving is a Class C misdemeanor DUI. A first offense carries fines up to $500, community service hours, a mandatory alcohol awareness class, and a 30-day license suspension. Parent or guardian attendance at the class may be required for defendants under 18.
ALR and License Suspension After an Edinburg DWI
A DWI arrest in Edinburg triggers two separate legal proceedings. The criminal case goes through Hidalgo County courts. The Administrative License Revocation process runs through Texas DPS under Transportation Code Chapter 524. Both are independent. A dismissal in criminal court does not cancel the ALR suspension.
After the arrest, the officer confiscates your physical license and gives you a temporary driving permit valid for 40 days. You have 15 days to request a hearing through DPS. Missing the deadline means the suspension takes effect on day 40 with no opportunity to contest it. The ALR hearing is conducted by the State Office of Administrative Hearings using a preponderance of the evidence standard, which is lower than the criminal standard of proof.
Refusing the breath or blood test results in a 180-day suspension for a first refusal. A second refusal within ten years brings two years. Failing the test at 0.08 or higher means a 90-day suspension for a first offense and one year for a repeat within ten years.
