Deferred disposition records show the deferral period (usually 12 months), required conditions like DWI education courses, community service, and no new alcohol violations. If the defendant completes the terms, the case is dismissed. If they don't, a conviction is entered. Both outcomes are documented in the court record.

Dallas DWI Laws and Penalties

Dallas DWI prosecutions follow Texas Penal Code Chapter 49. A standard first DWI is a Class B misdemeanor. Conviction means at least 72 hours in jail (up to 180 days) and a fine up to $2,000. Having an open container in the vehicle bumps the minimum to six days. A BAC of 0.15 or more makes it a Class A misdemeanor with up to one year in jail and fines up to $4,000.

Under Sec. 49.09, a second DWI carries a 30-day mandatory minimum and Class A designation. A third offense is a third-degree felony with 2 to 10 years in prison. Intoxication assault (Sec. 49.07) is also a third-degree felony. If the victim is a peace officer or firefighter, it jumps to a second or first-degree felony. Intoxication manslaughter under Sec. 49.08 is a second-degree felony with 2 to 20 years.

The state adds financial penalties beyond the court fine. TxDOT's penalty guidelines show that state surcharges of $3,000 to $6,000 are added at sentencing. These are separate from court fines and go directly to the state. Community supervision, DWI education courses, and ignition interlock devices are also common conditions in Dallas County courts.

Administrative License Revocation in Dallas

After a DWI arrest in Dallas, the Administrative License Revocation process starts immediately. Under Texas Transportation Code Chapter 524, the officer takes the physical license and issues a Notice of Suspension. You have 15 days to request a hearing. No hearing request means the suspension takes effect on day 40. Hearings are conducted by the State Office of Administrative Hearings, not the criminal court.

For a first DWI arrest where the driver fails the test, the suspension is 90 days. Refusing to test brings a 180-day suspension. With prior suspensions in the past 10 years, those periods increase significantly. After suspension ends, you pay a $125 reinstatement fee to Texas DPS. DPS driving records showing the suspension history can be ordered at dps.texas.gov.
